*1 In January of 2016, petitioner 854-856 Flushing Realty, LLC (the “Landlord”), commenced a commercial summary holdover proceeding against respondent Good Luck Laundromat, Inc. (the “Tenant”), to recover possession of the Ground Floor Store and Basement located at 854-856 Flushing Avenue, Brooklyn, New York 11216 (the “Premises”), pursuant to a Thirty-Day Notice of Termination of an oral month-to-month lease between said parties.¹ The Petition also sought “use and occupancy” payments due from October 2013.²*2
