*1  Upon the foregoing cited papers, the Decision/Order in the Cross-Motion to Punish Respondents for Civil Contempt and for assessment of Civil Penalties is as follows: Petitioner, Sandra Faber is the owner of a duplex unit located on the 10th floor in a condominium apartment building located at 135 West 14th Street, New York, NY. Mark MacKenzie was Sandra Faber’s husband who had unfortunately passed away during the pendency of this proceeding. Mark MacKenzie was a co-owner of the duplex unit and the former named Petitioner.
