MEMORANDUM & ORDER

*1  Presently before the court is the motion of Hoi L. Wan (“plaintiff”) pursuant to Federal Rule of Civil Procedure (“Rule”) 60(b) to vacate the dismissal of this action and the judgment entered on October 5, 2017. (See Judgment, ECF No. 7; see also October 3, 2017 Docket Order; Notice of Motion, ECF No. 9). In support of the motion, plaintiff has submitted a memorandum of law (“Mem.,” ECF No. 10). For the reasons that follow, plaintiff’s motion is denied. BackgroundPlaintiff commenced the instant action by filing a complaint (the “complaint,” ECF No. 1), on March 20, 2017, alleging violations of his rights under Title VII of the Civil Rights Act of 1964 (“Title VII”), 42 U.S.C. §§2000e, et seq., and New York State law.
