ESTATE OF ROBERTA MANDELL, Deceased (09/3979/B) — In this final accounting of the Public Administrator in the estate of Roberta Mandell, the court is asked to determine the identity of decedent’s distributees. Based upon the proof submitted before a court attorney-referee, the court finds that decedent was survived by one sister (who post-deceased) as her sole distributee.Accordingly, the Public Administrator is directed to distribute the net estate to Francine Alagappan as executor of the estate of Dolores Friedman, decedent’s post-deceased sister.The Public Administrator shall supplement her account by affidavit and as so supplemented the account is settled.Settle decree.Dated: March 23, 2018Surrogate MellaESTATE OF SHIRLEY M. MAYO, Deceased (10/2724/G/H/I) — This is the third petition by Andrew E. Mayo, as administrator of the estate of Shirley Mayo, deceased, to allocate and distribute the net proceeds of settlements with various defendants of causes of action for decedent’s conscious pain and suffering and wrongful death relating to her exposure to asbestos in the course of her employment as a school principal.By order dated July 5, 2017, the Supreme Court, New York County: (1) approved the compromise of such causes of action against certain defendant, (2) fixed attorneys fees and disbursements, (3) approved payment in satisfaction of a Medicare lien, and (4) ordered that the balance of the settlement proceeds be held in an interest-bearing escrow account pending further order of the Surrogate’s Court as to allocation and distribution.The proposed allocation and distribution of these settlement proceeds are identical to the relief sought and approved by this court in the first proceedings, namely, 60 percent to the cause of action for conscious pain and suffering and 40 percent to the cause of action for wrongful death and distribution of the net proceeds in accordance with EPTL 4-1.1(a)(1) and 5-4.4. Statutory commissions (SCPA 2307) and reimbursement for decedent’s funeral services have been waived.There being no opposition to the relief requested in this petition, it is granted. The restrictions contained in the letters issued to the administrator are removed and he is authorized to collect the settlement and execute the necessary receipts and releases with respect to defendant Manville, now being administered through the Manville Trust. The restrictions shall remain in full force and effect with regard to any remaining defendants.The net proceeds shall be paid as proposed in the petition.Decree settling administrator’s account signed.Dated: March 23, 2018ESTATE OF SHIRLEY M.
