The administrator is authorized to pay the sum of $4,084.94 to the Department of Social Services, in full satisfaction of its claim.The restrictions contained in the letters issued to the administrator are removed, and she is authorized to collect the settlement proceeds and to execute the necessary receipts and releases. TOM, Deceased (16/768/B/C/D) — In this proceeding to remove the preliminary executor of the estate of Edward S. Tom, respondent appeared at the calendar but did not object. After a conference with the court, the parties filed a stipulation of settlement, whereby respondent consented to the appointment of Donald S. Tom as the successor fiduciary and agreed to a deadline by which he would file his account with the court. Based upon a review of the records before the court, such removal is warranted. The petitioners’ application is granted to the extent set forth below. All other relief requested by petitioners is denied without prejudice to renew in an appropriate proceeding.The preliminary letters testamentary previously issued to Howard Tom are hereby revoked. Howard Tom is directed to file an account of his proceedings, together with a petition for its judicial settlement, no later than March 15, 2018. Successor preliminary letters testamentary shall issue to Donald S. Tom, upon his duly qualifying according to law.Settle decree.Dated: February 27, 2018
