McGrath, HanaIt is Ordered that the respondent-appellant’s motion seeking to enlarge the time to perfect the appeal and to continue the stay is granted, without opposition, on condition that respondent-appellant: 1) perfect the appeal by the September 2018 term – the filing deadline for which is July 10, 2018; and 2) continue to pay landlord accruing use and occupancy, pursuant to Civil Court order (Lau, J.), dated March 16, 2017, in the amount of $1,831.28, on or before each subsequent rental due date, without prejudice. In the event of respondent-appellant’s failure to comply with the foregoing conditions, petitioner-landlord may move on five days notice for an order vacating the stay.
