Surrogate Malave-GonzalezESTATE OF ALEJANDRINA DOBLES NIEVES, Deceased (17/2402) — In this application by a daughter of the decedent for the issuance of limited letters of administration to pursue a cause of action, jurisdiction was obtained over the decedent’s son who is alleged to be under a disability. Another daughter has signed a waiver and consents to the application. It would appear that, if the son’s disability caused his default, he would be ineligible to serve as the fiduciary of the estate. Of course, if appropriate, a guardian ad litem shall be appointed for the son in any future accounting or other proceeding.Accordingly, in the absence of any appearance in opposition the application is granted. Letters of administration subject to the limitations of SCPA 702 (1) with respect to any causes of action shall issue to the petitioner.Submit decree.June 19, 2018

ESTATE OF ANA RUIZ, Deceased (17/2451) — On the return date of citation in this proceeding by an alleged creditor for the issuance of letters of administration to the Public Administrator, jurisdiction was obtained over only four of the decedent’s five children and they defaulted, and the Public Administrator appeared and consented to the issuance of letters of administration, limited to receiving process in an action to expunge a satisfaction of mortgage dated December 6, 2010, without any duty to defend. The matter was marked “supplemental citation” inasmuch as it appeared that jurisdiction had not been obtained over a son; however, a waiver and consent is now filed for that son.Accordingly, the application is granted. Letters of administration shall issue to the Public Administrator limited in the manner requested.Settle decree.June 22, 2018
