D’Angelo, Jr., in effect, for leave to reargue a disciplinary proceeding against him, which was determined by an opinion and order of this Court dated December 29, 2017, and, upon reargument, to modify the sanction imposed, or, in the alternative, for leave to appeal to the Court of Appeals from the opinion and order of this Court. Mr. D’Angelo was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 9, 1986. By decision and order on motion of this Court dated August 24, 2016, the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against Mr. D’Angelo based on the acts of professional misconduct set forth in a verified petition dated January 28, 2016, Mr. D’Angelo was barred from relitigating any of the factual allegations raised in charges one through four of the petition, based upon the doctrine of collateral estoppel, and the matter was referred to the Honorable Elaine Jackson Stack, as Special Referee, to hear and report. By an opinion and order of this Court dated December 29, 2017, Mr. D’Angelo was disbarred, effectively immediately, based on 12 charges of professional misconduct, and his name was stricken from the roll of attorneys.Upon the papers filed in support of the motion and the papers filed in opposition thereto, it isORDERED that the motion is denied.SCHEINKMAN, P.J., MASTRO, RIVERA, DILLON and BALKIN, JJ., concur.
