ESTATE OF ALANA OBEY, Deceased (12-2433/A) — The administrator, the decedent’s son, seeks to remove the restrictions on his limited letters of administration so that he may receive and judicially account for the settlement proceeds of a personal injury cause of action.The decedent sustained injuries allegedly after being struck by falling ceiling and died intestate on August 26, 2011, of unrelated causes. The decedent’s only other distributee, a daughter, and the New York State Department of Taxation and Finance consents to the application.Disbursements are allowed in the reduced sum of $1,852.85 eliminating certain items normally considered office overhead. Counsel fees are allowed pursuant to the retainer agreement. The sum of $2,535.53 is to be paid to the Human Resources Association for public assistance rendered to the decedent. The sum of $1,893.91 is to be paid to Equian for its claim. The net distributable proceeds are to be paid to the decedent’s children in equal shares (EPTL 4-1.1 [a][3]).Decree signed.September 5, 2018
