ESTATE OF DAVID RAPPAPORT, Deceased (10/2371/E);ESTATE OF DAVID RAPPAPORT, Deceased (10/2371 F) — At the call of the calendar, the motion by Michael Rappaport and Eleanor Burton in the above-captioned proceeding was granted in part and denied in part. To the extent movants sought to discontinue their petition seeking relief from Errol Rappaport pursuant to SCPA 2102 and 2103, their motion was granted. To the extent movants sought dismissal of Errol Rappaport’s cross-petition to remove them as co-executors of the estate of David Rappaport, their motion was denied. The court, sua sponte, consolidated Errol Rappaport’s cross-petition (File No. 2010-2371 F) with the petition filed by Michael Rappaport and Eleanor Burton for judicial settlement of their account as co-executors (File No. 2010-2371 I).This decision constitutes the order of the court.Dated: October 15, 2018.
