After reviewing the petition and the documents attached thereto, the petition is granted.The Letters shall be limited to the filing of a claim, or the continuation of a claim, and the collection of an award for decedent’s personal injuries and/or wrongful death made to the September 11th Victims’ Compensation Fund, pursuant to the Zadroga Act, and the Executor is hereby restrained from a compromise of such action or any other action and/or the enforcement of any judgment recovered therein until the further Order of this Court upon the filing of satisfactory security, or the order of any court of competent jurisdiction (EPTL 5-4.6). No distribution of assets collected from the September 11th Victims’ Compensation Fund, pursuant to the Zadroga Act, may be made until a compromise proceeding has been filed and reviewed by the Court.Additionally, letters are restricted to the collection and administration of all other assets of the estate.The Court hereby dispenses with the filing of a bond.Limited and Restricted Testamentary Letters shall issue to Diane M. DIMINO, A/K/A CHARLES ANTHONY DIMINO, Deceased (16/900/D) — In this compromise proceeding, it appears that Joan Dimino, surviving spouse, may be an incapacitated person incapable of adequately protecting her rights.Accordingly, the Court appoints Anthony S. Danna, Esq., pursuant to SCPA 311 as the Designee for the alleged incapacitated person.In addition to the service of process under SCPA 307 upon the alleged incapacitated person, a copy of the process issued shall be served by personal delivery upon the Designee at least ten (10) days before the return date of the Citation.This decision shall constitute the Order of the Court.Proceed accordingly.Dated: September 18, 2018
