Surrogate MellaESTATE OF BARBARA WEIDEN SCHWARTZ FISCHLER, Deceased (11-2968/D) — At the call of the September 18, 2018 calendar, the court granted the motion — filed by Russell W. Rosen and Steven F. Schwartz, successor temporary co-administrators of the estate of Barbara Weiden Schwartz Fischler and, as such, objectants in a proceeding commenced by Burton M. Fischler for settlement of his account as former temporary administrator of decedent’s estate — to the extent movants sought partial summary determination. The court granted this motion on the consent of Wilson, Elser, Moskowitz, Edelman & Dicker and in the absence of opposition from decedent’s son, for whom a guardian ad litem has been appointed. Movants’ request for the imposition of sanctions was withdrawn prior to the return day. Movants’ request for an order directing that the aspect of the proceeding on which summary determination has been granted be severed from the rest of the proceeding (see CPLR 3212 [e] [1]) is denied as unnecessary.This decision, together with the transcript of the September 18, 2018 proceedings, constitutes the order of the court.Dated: November 7, 2018
