Surrogate Malave-GonzalezESTATE OF CUTHBERT BETHELMIE, Deceased (00/D 227 P) — The executor, one of the decedent’s daughters, seeks to distribute from her attorneys’ escrow account the remaining proceeds of causes of action settled in the Supreme Court, New York County, before a Special Master. The causes of action arose from the decedent’s exposure to asbestos. The supreme court order, inter alia, directed the payment of counsel fees, disbursements and partial reimbursement of the decedent’s funeral expenses.The decedent died on November 16, 1999. In addition to the petitioner, his distributees are a spouse who is the sole residuary beneficiary and four other daughters. Similar applications were approved previously. Under the circumstances presented, including the consents of all of the other distributees and the New York State Department of Taxation and Finance, and the lack of any unsatisfied debts or claims presented herein, the court grants the request to allocate 90 percent of the settlement proceeds to the personal injury cause of action and the balance to the wrongful death cause of action.There being no remaining funds allocated to personal injury, the funds allocated to wrongful death are to be paid to the spouse. The restrictions imposed upon the executor and her counsel shall remain in full force and effect with regard to any remaining defendants and causes of action.Decree signed.October 29, 2018

ESTATE OF ELIEZER VEGA, Deceased (18-1008) — In this application by an alleged creditor, a landlord seeking to obtain possession of a unit in which decedent resided, for the issuance of letters of administration to the Public Administrator, limited to securing possession of the unit, jurisdiction is complete and counsel for the Public Administrator appeared and consented to receipt of letters of administration limited to receiving process in an appropriate proceeding for the recovery of the unit.Accordingly, in the absence of any appearance in opposition, letters of administration shall issue to the Public Administrator, limited as consented.Submit decree.November 1, 2018
