Thereafter a cross-petition was filed for probate of a later instrument, dated November 18, 2005. The parties have resolved their differences, and in view of the problematic physical condition of the 2005 instrument, the cross-petition was withdrawn pursuant to a stipulation of settlement filed with the court. Incident to the settlement, a miscellaneous proceeding was discontinued.The proof establishes that the propounded instrument dated March 9, 2000, is genuine, that it was validly executed, and that, at the time of its execution, decedent was competent to make a will and under no restraint (EPTL 3-2.1; SCPA 1408). Accordingly the propounded instrument is admitted to probate subject to the terms of the stipulation. The preliminary letters testamentary previously issued to Morris Libman are hereby revoked.
