ESTATE OF GABRIELA LEACH, Deceased (15-3494/A/B/C) — The settlement of causes of action for decedent’s pain and suffering and wrongful death were approved, and attorney’s compensation and disbursements fixed by an order of the Supreme Court, New York County, dated April 9, 2018. The administrator has petitioned for leave to allocate and distribute the proceeds of this settlement.The restrictions on the letters of administration issued by this court are removed, and the administrator is authorized to collect the compromise proceeds.The proposed allocation of one hundred percent (100 percent) of the settlement proceeds to the cause of action for conscious pain and suffering is approved.The petitioner is authorized to reimburse the law firm of Sullivan Papain Block McGrath & Cannavo, P.C., $970.00, for the payment of an additional Surrogate’s Court filing fee. The petitioner is authorized to pay herself statutory commissions in the amount of $23,029.75, and to reimburse herself for funeral expenses in the amount of $2,350.00. The petitioner is also authorized to pay the claim of 1199 SEIU Funds Benefit and Pension, for decedent’s medical costs, in the amount of $72,100.00 in full satisfaction of its lien.The balance of the proceeds shall be distributed in equal shares to decedent’s mother, Emma Isabel Ferro and to the estate of the decedent’s post-deceased father, Carlos Alberto Zigaran, pursuant to EPTL 4-1.1(a)(4).Decree signed.Dated: April 8, 2019
