Surrogate AndersonESTATE OF PHOEBE KAHANOV, Deceased (13-1045) — Decedent Phoebe Kahanov was diagnosed with cancer and eventually died, allegedly as a result of exposure to dust from the collapse of the World Trade Center Towers, which occurred near her residence. In this proceeding, decedent’s husband, the executor of her estate (herein, “petitioner”), seeks permission to collect and distribute proceeds from the September 11th Victim Compensation Fund (the “Fund”) and further seeks judicial settlement of his account with respect to those proceeds. The guardian ad litem appointed for decedent’s two minor children has filed a report in which he states that he believes that award is in the best interests of his wards, and he has no objection to the requested relief.The petition is granted. The restrictions contained in the letters issued to petitioner are removed, and he is authorized to collect the settlement and execute the necessary receipts and releases. The settlement proceeds are allocated as follows: 51.49 percent to the cause of action for wrongful death and 48.51 percent to the cause of action for pain and suffering.The fees of petitioner’s attorneys and the compensation of the guardian ad litem are fixed and determined as set forth in the decree.
