Surrogate AndersonEstate of PENELOPE VERAS, Deceased, (12-1303/A) — The administrator’s application for leave to compromise causes of action for decedent’s wrongful death and conscious pain and suffering is granted. The restrictions contained in the letters issued to petitioner are removed, and he is authorized to collect the settlement and execute the necessary receipts and releases. The proceeds are allocated onehundred ( 100%) percent to the cause of action for wrongful death.The guardian ad litem for decedent’s two minor children has filed a report and a supplemental report wherein she approves the proposed distribution of the settlement proceeds, calculated according to Matter of Kaiser (198 Misc 582 [Sur Ct, Kings County 1950]) and has no objection to the requested relief.The fees and disbursements of petitioner’s attorney are fixed and determined. Funeral expenses were paid by decedent’s father, and he has waived reimbursement. As requested, the administrator is authorized to pay $7,868.16 to 314A LLC, in full payment of its lien for an advance paid to petitioner for his and his daughters’ benefit.The balance of the settlement proceeds, after payment of the guardian ad litem’ s compensation, shall be distributed to decedent’s distributees as set forth in the decree.
