Surrogate MellaESTATE OF PHINEAS BLUMIN RAMSEY, Deceased (18-494/B/C);ESTATE OF THEODORE BLUMIN RAMSEY, Deceased (18-495/B/C); — At the call of the calendar on April 30, 2019, the court granted, to the extent described in more detail below, these petitions to compromise claims related to the deaths of these two decedents who died together in an accident. The balance of the relief sought in the petitions — including the allocation and distribution of the settlement proceeds — has been adjourned to June 7, 2019, to join a party with an interest in that portion of the relief.Compromise of the claims, as proposed by petitioner, is approved, and the petitioner is authorized to collect the settlement proceeds and execute the necessary receipts and releases. The restrictions contained in the letters issued to the Administrator are modified in order to accomplish the compromise and settlement of these claims. The Administrator, however, is directed to hold the proceeds in an attorney-escrow account, pending further order of the court with respect to the allocation and distribution of these proceeds. Accordingly, it isORDERED, ADJUDGED AND DECREED that the petitioner as Administrator of these decedents’ estates is authorized to settle and discontinue the claims against defendant Ithaca Consulting, Inc., and its insurer, U.S. Specialty Marine, and petitioner is authorized to deliver general releases and discontinuances and any other papers or documents that may be required to effectuate the settlements and discontinuances or withdrawals of the said claims, and it is furtherORDERED, ADJUDGED AND DECREED that the giving of a bond or other security in connection therewith be dispensed with, and that the restrictions on the Letters of Administration be modified to allow the above-described settlement and the collection of the settlement proceeds, but remain in full force and effect with respect to distribution of these proceeds; and it is furtherORDERED, ADJUDGED AND DECREED that the Administrator is directed to hold the proceeds of these settlements in an interest-bearing escrow account until further order of this court.This decision constitutes the order of the court.Dated: May 2, 2019
