Surrogate AndersonESTATE OF MILLICENT BURGHER, Deceased (13-3228/A) — The administrator’s petition for leave to compromise a cause of action for decedent’s conscious pain and suffering is granted. The restrictions contained in the letters issued to the administrator are removed, and she is authorized to collect the settlement and execute the necessary receipts and releases. The fees and disbursements of the administrator’s attorney and the commissions of the administrator are fixed and determined.The administrator is authorized to pay $7,495.75 to decedent’s father for reimbursement of the funeral expenses. The administrator is further authorized to pay $15,839.29 to New York City Department of Human Services/HRA in full payment of its lien. The balance of the settlement proceeds shall be distributed to decedent’s distributees, pursuant EPTL 4-1.1(a)(3), as set forth in the decree.The account is settled, and the decree is signed.Dated: June 3, 2019

Matter of KISHA GAY HAIRE, Beneficiary (84-0894/A) — Incident to this uncontested accounting proceeding by the co-trustees of a supplemental needs trust, established for the benefit of Kisha Gay Haire, to settle their account for the period January 5, 1995 through February 28, 2017, petitioners seek permission to resign as co-trustees and appointment of successor co-trustees. Because Article EIGHTH of the trust agreement provides a mechanism for resignation of trustees and appointment of successor trustees without court intervention, petitioners seek relief that they do not need, and the request is denied.The fees and disbursements of the attorneys for the copetitioner corporate co-trustee are fixed and determined as set forth in the decree.The account is settled, and the decree signed.Dated: June 4, 2019
