Surrogate AndersonWill of EFRAIM MARGOLIN (18-2711 C/D), Deceased — Two co-trustees of a trust created under ·the will of decedent Efraim Margolin seek the Court’s acceptance of the resignation ·of one co-trustee and the appointment of a successor trustee in accordance with the term of Article D (9) of decedent’s will. An income beneficiary opposed the application and was granted leave to submit a responsive pleading.Objectant’s unsworn and uncaptioned response consists of rambling statements which are irrelevant to the resignation of a co-trustee and the appointment of a successor trustee. Objectant fails to provide the court with any legal basis for denial of petitioner’s application.All remaining interested parties, incl~ding the Attorney General, have no objection to petitioner’s application. The procedure undertaken by the co-trustees for the resignation and appointment of a fiduciary is in accordance with decedent’s wishes as set forth in Article 9 (D) of the testamentary instrument.Petitioner’s application is therefore granted. Letters·of trusteeship previously issued to Frances Carlisle are hereby revoked, and letters of successor trusteeship shall issue to Sonja J.M. Cooper, who shall serve as co-trustee with Fred C. Rosenberg, upon her duly qualifying according to law.Decree signed.Dated: June 11, 2019
