Surrogate MellaESTATE OF CHI-CHUAN WANG, Deceased (03-2550/K) — At the call of the June 7, 2019 calendar, the court granted the motion, to the extent set forth hereinafter, of Yien-Koo Wang King, preliminary executor of the estate of Chi-Chuan Wang, in a proceeding commenced by Shou-Kung Wang for revocation of her letters and for related relief. Movant had sought an order that would “expand or clarify her authority under her preliminary letters in order to explicitly authorize her to bring an action in the British Virgin Islands intended to gather evidence in aid of the estate of Chi-Chuan Wang’s RICO action currently pending against Andrew Wang and Shou-Kung Wang in the Southern District.”The court stated that Yien-Koo Wang King’s authority as preliminary executor of decedent’s estate — which has been limited to the prosecution of the RICO action she has commenced against Andrew Wang and others in the Southern District of New York (see Matter of Wang, 2019 NY Slip Op 30308 [U]) — includes the authority to commence an action in the British Virgin Islands for the purpose of gathering evidence to be used in the RICO action against Andrew Wang in the Southern District of New York. The court noted that it was granting the motion — to the extent stated — but that it was not opining on the truth or accuracy of the allegations asserted by movant of wrongdoing by the defendants in the RICO action.This decision, together with a transcript of the June 7, 2019 proceedings, constitutes the order of the court.Dated: June 11, 2019
