Surrogate MellaESTATE OF HERBERT V. SMITH, JR., Deceased (17-75/A/B/C) — The settlement of causes of action for decedent’s personal injuries were approved, and attorney’s compensation and disbursements have been fixed by an order of the Supreme Court, Bronx County, dated April 30, 2018. The administrator has now petitioned for leave to distribute the net proceeds of this settlement.The restrictions on the letters of administration issued by this court are removed, and the administrator is authorized to collect the compromise proceeds. Quinneisha Maria Seeley-Guerrero, the administrator, is authorized to pay: (1) Vanessa Huntley the sum of $7,026.00 as reimbursement for decedent’s funeral expenses and $790.80 for storage costs; (2) the New York City Human Resources Administration, Department of Social Services, the sum of $20,000 in full satisfaction of its Medicaid lien; and (3) Gershowitz, Libo & Korek, P.C., the sum of $515.00 as reimbursement for additional court filing fees. The administrator is also authorized to pay herself statutory commissions in the requested amount of $2,534.50 (see SCPA 2307).The net proceeds, with interest, shall be distributed entirely to petitioner, as guardian of the property of decedent’s son and sole distributee, Mekhi Smith (EPTL 4-1.1[a][3]), such funds to be held jointly with the guardian clerk of the court. Decree signed.Dated: July 12, 2019
