Surrogate AndersonESTATE OF TONY HSUEH YEN TONG, Deceased (16-1146/A/B/C) — In this miscellaneous proceeding, the administrator of the estate of Tony Hseuh Yen Tong seeks permission to collect and distribute the proceeds of a recovery from the September 11th Victim Compensation Fund (the “Fund”) and further seeks judicial settlement of her account with respect to those proceeds.The administrator’s petition is granted. The restrictions contained in the letters issued to her are removed, and she is authorized to collect the amount due from the Fund and to execute the necessary receipts and releases. The settlement proceeds have been allocated as follows: 58.40 percent to the cause of action for wrongful death and 41.60 percent to the cause of action for personal injury.The fees and disbursements of petitioner’s attorney are fixed and determined. The funeral expenses have been paid by petitioner, and she has waived reimbursement as well as commissions. The balance of the settlement proceeds shall be distributed to petitioner in accordance with EPTL 4-1.1 and EPTL 5-4.4.The account is settled, and the decree is signed.Dated: July 18, 2019
