Surrogate Anderson ESTATE OF JAY A. LITWIN, Deceased (18-1655) — This is an uncontested proceeding to probate a lost will. The proof establishes that after execution, the original instrument dated September 26, 2012 was retained by the draftsperson who could not locate it after she changed law firm offices. Accordingly, the presumption that decedent revoked the will (SCPA §1407[1]) does not apply. The court is satisfied that the instrument was executed validly and that at the time of execution the decedent was competent in all respects to make a will and not under restraint (EPTL §3-2.1; SCPA §§1407[2] and 1408). In addition, the provisions of the lost will have been established by a photocopy which was proved to be a true and complete copy of the will as executed (SCPA §1407[3]). Decree, incorporating the terms of the lost will, signed. Dated: October 8, 2019

ESTATE OF RACHEL WALDMAN, Deceased (13-1457) — At the call of the calendar, this uncontested application by the trustees of a trust created under’ Article SECOND of the will of Rachel Waldman, seeking permission to resign and appointment of successor trustees was granted. Letters of trusteeship issued to Gilda Guttman and Anne Waldman Gober shall be revoked. Letters of successor trusteeship shall issue to Vivian Kestenbaum and Elizabeth Kestenbaum upon their duly qualifying according to law. Decree signed. Dated: October 8, 2019
