Surrogate Titone ESTATE OF THOMAS ADDESSI, Deceased (19-132) — In this contested administration proceeding, a Stipulation of Settlement resolving all outstanding issues, including the withdrawal of objections by Kelly Scotto, was filed with this Court on May 21, 2019. The Guardian ad Litem, appointed on behalf of infants as interested parties, has filed his report recommending the approval of the filed settlement. The approval by the Guardian ad Litem of the filed Stipulation is hereby ratified and the fee of the Guardian ad Litem is set as indicated in the file. Said fee shall be paid within 30 days of the date of the Decree to be submitted pursuant to this decision. Jurisdiction having been obtained over all necessary parties, including Eger Nursing Home, and upon the recommendation of the Guardian ad Litem, the application is hereby granted. Letters of Administration shall issue to Concetta Addessi, upon her duly qualifying according to law. The net proceeds of the sale, (i.e., after payment of customary closing costs, including attorney fees and broker’s commissions), shall be paid to Barone & Barone, LLP, as attorney and escrow agent for Concetta Addessi, Administrator of the Estate of Thomas Addessi. Toni Ann Barone, Esq., shall immediately thereafter deposit said funds into an attorney escrow account. Distribution of the net proceeds of the within sale is prohibited without prior approval of this Court. Upon the scheduling of a closing date, Toni Ann Barone, Esq., shall notify the Court and schedule a Court appearance which is to occur within thirty (30) days after closing. At the Court conference, all interested counsel, as well as the Guardian ad Litem, will appear to address the distribution of the net proceeds of the sale. At least three days prior to the conference, Toni Ann Barone, Esq., shall provide copies of all closing documents to the Court, all interested counsel and the guardian ad Litem. The decision and order of the Court dated February 22, 2019 that set a bond in the amount of $192,000.00, and the decision and order of the Court dated October 16, 2019 are hereby vacated. Submit Decree upon Notice of Settlement to the Guardian ad Litem, and Jacobowitz and Gubits, LLP. ESTATE OF JACINTO M. FRANCESCHI, Deceased (16-939) — In this pending administration proceeding, the Court appointed Duane C. Felton, Esq., as Guardian ad Litem to represent Daniella Franceschi, an infant distributee and unknown distributees. The Court has been advised that Duane C. Felton, Esq., cannot accept the appointment. Accordingly, the Court relieves him of the appointment. The Court hereby appoints Mark Piazza, Esq., as Guardian ad Litem to serve in the place and stead of Duane C. Felton, Esq. The appointment is effective upon the Guardian ad Litem filing Form UCS 872 entitled “Notice of Appointment and Certification of Compliance,” and upon the Guardian ad Litem duly qualifying pursuant to Uniform Rules for the Surrogate’s Court Section 207.13(A).
