Surrogate Mella ESTATE OF FRANCES CERULLO, Deceased (18-3327/A) — At the call of the calendar on October 11, 2019, counsel for Michele Cerullo McAvoy and Michael Cerullo appeared on their cross-petition for the issuance of letters of administration. A decree of this court dated October 4, 2018, previously granted letters of administration to Donato Cerullo, a respondent on the instant petition, upon his filing a bond in the sum of $200,000. The bond has not been posted and letters have not issued. Mr. Cerullo did not appear on October 11, 2019, nor has any opposition to this application been filed. Pursuant to SCPA 1006, the court directs Mr. Cerullo, to file the bond and qualify as administrator by November 18, 2019. In default thereof, Mr. Cerullo will be deemed to have renounced his appointment and the cross-petition for letters of administration will be granted upon the submission of a decree by cross-petitioners. Clerk to notify Donato Cerullo and counsel for cross-petitioners. Dated: October 31, 2019.
