Surrogate Anderson ESTATE OF RYAN JAYCE MARTE, a/k/a RYAN COREY, Deceased (17-122/A/B) — This is a proceeding to revoke the letters of administration issued to the Public Administrator in the estate of Ryan Jayce Marte. Incident to the proceeding, petitioner sought a kinship hearing to determine his status as decedent’s sole distributee. Based upon the proof submitted at a kinship hearing before a court attorney-referee, the court finds that decedent was survived by his father as his sole distributee. Accordingly, letters of administration issued to the Public Administrator shall be revoked. Letters d.b.n. shall issue to Reynaldo Marte, decedent’s father and sole distributee. Decree signed. Surrogate Mella ESTATE OF MARY HILSON WOLF, Deceased (87-1848/J; 87-1848/M; 87-1848/P) — On October 11,2017 — more than two years ago — the court dismissed the amended objections of Wendy Levey and Mariel Levey to the accounts of Howard Sloan, former successor co-trustee of trusts under Articles FOURTH, FIFTH, and SIXTH of the will of Mary Hilson Wolf, respectively, for the primary benefit of Wendy Levey and others (see CPLR 3211 [a] [1]). As a result, the companion accounting proceedings, of which Robert E. Smith, executor of Howard Sloan’s will, is petitioner, became uncontested. Nevertheless — despite numerous requests by the court — petitioner has yet to settle proposed accounting decrees. Unless petitioner settles proposed accounting decrees by February 28,2020, the court, exercising its supervisory function, will dismiss the petitions on the basis that petitioner has neglected to prosecute them diligently (SCPA 209 [8]; see Matter of Velazquez, NYLJ, Jun. 3, 2019, at 24, col 3 [Sur Ct, NY County]). This decision constitutes the order of the court.
