Surrogate Mella ESTATE OF RONALD BRUCE YETTER, Deceased (09-44/AT/AU/AV) — Settlements of causes of action for decedent’s pain and suffering and wrongful death were approved and the attorney’s compensation and disbursements fixed, by an order of the Supreme Court, New York County, dated January 2, 2019. The causes of action arose from the decedent’s exposure to asbestos. The administrator has petitioned for leave to allocate and distribute the proceeds of these settlements. The restrictions on the letters of administration issued by this court are removed, and the administrator is authorized to collect the compromise proceeds with respect to defendant Federal Mogul now being administered through the Federal Mogul Trust. The restrictions shall remain in full force and effect with regard to any remaining defendants and causes of action. The proposed allocation of forty percent (40 percent) to wrongful death and sixty percent (60 percent) to conscious pain and suffering is approved. The net proceeds allocated to the cause of action for wrongful death shall be paid entirely to Jeffrey Scott Boyd, as personal representative of the estate of decedent’s post-deceased spouse, Jean Applegate-Yetter, pursuant to EPTL 5-4.4. The net proceeds allocated to the cause of action for conscious pain and suffering, shall be divided among the estate of decedent’s post-deceased spouse Jean Applegate-Yetter, and decedent’s children, namely, Edward James Yetter, Ronnie Bruce Ratcliff, Bijonn Avery Yetter and Janette Nola Yetter Foncerrada, pursuant to EPTL 4-1.1, as specified in the decree.
