Surrogate Titone ESTATE OF ANNA GILDERSLEEVE, Deceased (19-322; 2019-322/A) — Limited Letters of Administration were previously issued to the fiduciary herein on May 1, 2019. The fiduciary currently requests that the letters now be amended and issued without the necessity of posting a bond, to authorize the collection of all estate assets existing as of the death of the deceased. Upon the documents submitted in support of said application, the request is granted. The powers of the fiduciary are limited regarding the prosecution or enforcement of a cause of action, and the fiduciary is hereby restrained from a compromise of such action or any other action and/or the enforcement of any judgment recovered therein until the further order of this court, upon the filing of satisfactory security. Said letters are also restricted to the collection and administration of all other assets of the estate existing as of the date of death of the deceased. The court hereby dispenses the filing of a bond. The previously issued Limited Letters of Administration are now amended to be Limited and Restricted Letters of Administration. ESTATE OF ANTOINETTE JONES, A/K/A ANTOINETTE DENISE JONES, Deceased (06-663/B) — The limited administrator of this estate has moved to modify the limitations contained in the Limited Letters of Administration issued by this Court on May 9, 2007 so as to enable him to compromise a personal injury cause of action on behalf of decedent. Jurisdiction has been obtained over all necessary parties, including the New York State Department of Taxation and Finance, the Public Administrator of Richmond County, and Stradford Funeral Home. Objections have been formally withdrawn by the New York State Department of Taxation and Finance by waiver and consent signed and dated September 9, 2019. Further, a copy of a paid funeral bill to Stradford Funeral Home has been previously filed (See File No. 2006-663). Upon review of all the papers submitted, the application to modify the limitations and to settle the personal injury claim in the amount of $50,000.00 is approved. All proceeds are allocated to the cause of action for personal injury. Attorney fees, inclusive of disbursements, are fixed and allowed in the total amount of $18,033.49 to Wagner & Wagner, LLP. The net balance in the amount of $31,966.51 shall be paid to the decedent’s distributees pursuant to EPTL §4-1.1 as follows: $10,655.50 to Jamal Pratt, distribute of the decedent; $10,655.50 to Diamond Jones, distributee of the decedent; and $10,655.51 to the Public Administrator of Richmond County as the Administrator of the Estate of Malachi Uneek Stevenson, post-deceased distributee of the decedent. Incidental relief prayed for is granted. Submit decree. This matter shall be returnable on the court’s calendar of January 15, 2020 at 9:30 a.m. for the status on the submission of the decree.
