Surrogate Anderson ESTATE OF ANA AGUAYO, Deceased (16-2023/A) — This is a proceeding by the Public Administrator to settle her account as the administrator of the estate of Ana Aguayo and to determine the identity of decedent’s distributees. Objections were filed by an alleged maternal first cousin to the extent the petition failed to identify him as decedent’s distributee. A kinship hearing was held on April 5, 2019, and objectant, appearing pro se, presented documentary proof as to decedent’s maternal kin. The guardian ad litem for unknown distributees has filed his report in which he recommends that the estate be put on deposit since objectant failed to establish that decedent had no distributees closer in degree than first cousins. Accordingly, the record being insufficient to establish the identity of decedent’s distributees, the Public Administrator is directed to deposit the net estate with the Commissioner of Finance of the City of New York for the benefit of unknown distributees. The Public Administrator shall supplement the account by affidavit, and, as so supplemented, the account is settled. Settle decree providing for compensation of the guardian ad litem. STEIN, Deceased (10-1199/G) — On July 29, 2019, this court issued a decision and order in this proceeding for the enforcement of a stipulation in the estate of Robert L. Stein which has been inactive for more than three years. The order provided: “[T]he court will…dismiss this proceeding for failure to prosecute unless a party takes affirmative action either by filing a dispositive motion or a note of issue by November 15, 2019.” No party has filed a dispositive motion or a note of issue.
