Dated: December 5, 2019 ESTATE OF SALVATORE SESSA, Deceased (14-1221/A) — This is an application by the limited administratrix of this estate to modify the limitations contained in the Limited Letters of Administration issued by this Court on December 30, 2014 so as to enable her to compromise a wrongful death/conscious pain and suffering cause of action on behalf of the decedent. Waivers and consents from all the interested parties, including the New York State Department of Taxation and Finance, have been filed. Upon review of all the papers submitted, the application to modify the limitations and to settle the wrongful death/conscious pain and suffering cause of action in the amount of $437,189.68 is approved. The allocation of the net proceeds shall be 60 percent to the cause of action for conscious pain and suffering and 40 percent to the cause of action for wrongful death. Pursuant to EPTL 5-4.6, attorney fees, inclusive of disbursements, were fixed and allowed in the total amount of $168,447.08 to Weitz and Luxenberg, P.C. Additionally, payment in the amount of $6,252.35 to MSPRC in satisfaction of their claim was approved. The net balance in the amount of $262,490.25 shall be paid, pursuant to EPTL 4-1.1, as follows: $102,496.61 to Maria Sessa, surviving spouse; $17,498.97 to Michael Sessa, surviving son; $17,498.87 to Serafino Sessa, surviving son; and $17,498.86 to Sebastian Sessa, surviving son, for the portion of the settlement allocated to conscious pain and suffering; $107,497.04 to Maria Sessa, surviving spouse for the portion of the settlement allocated to wrongful death. The powers of the fiduciary are limited to the prosecution of any and all actions arising out of the September 11, 2001 terrorist attacks upon New York City, including, but not limited to, the following causes of action: (1) Burnett, et al. v. Petitioners contend that there will be a substantial delay in the completion of the probate proceeding. Due to this delay, and the need to marshal decedent’s property and pay the necessary expenses of the estate, petitioner has applied for Preliminary Letters Testamentary.
