By Mastro, J.P., Rivera, Dillon, Chambers, Duffy, JJ. IN THE MATTER OF JOHN J. BUDNICK, ADMITTED AS JOHN JOSEPH BUDNICK, A SUSPENDED ATTORNEY — Motion by John J. Budnick for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Budnick was admitted to the Bar at a term of the Supreme Court in the Second Judicial Department on February 11, 1975, under the name John Joseph Budnick. By opinion and order of this Court dated September 15, 2009, Mr. Budnick was suspended from the practice of law for a period of two years, based on three charges of professional misconduct. By decision and order on motion of this Court dated December 7, 2009, the effective date of Mr. Budnick’s suspension was extended until December 18, 2009. Upon the papers filed in support of the motion and the papers filed in relation thereto, it is ORDERED that the motion is denied with leave to renew upon submission of the following: (1) proof of obtaining a valid MPRE score from a test taken no more than one year prior to the date of the renewed motion (see 22 NYCRR 1240.16[b]); (2) proof of payment of $1,500 to Sebastiano Savona; (3) an affidavit of compliance pursuant to 22 NYCRR 1240.15[f]; (4) information regarding the status of the action entitled Lufker v. John J. Budnick, commenced in the Supreme Court, Nassau County, under Index No. 2010/013609; and (5) facts establishing that John Joseph Budnick possesses the requisite character and fitness to be reinstated to the practice of law.
