ESTATE OF SARAH LOUISE DRAYTON, Deceased (15-2800/A/B/C) — The application by the Administrator of the estate of Sarah Louise Drayton, deceased, to allocate and distribute the net settlement proceeds from causes of action for decedent’s conscious pain and suffering and wrongful death is approved. The restrictions in the letters of administration issued to petitioner, Betty Turner, on September 1, 2015, are hereby removed. The Administrator is authorized to collect the settlement proceeds and issue any instrument necessary to effectuate settlement. The Administrator is also authorized to reimburse herself the sum of $7,189.35 for decedent’s funeral expenses. Statutory commissions are approved in the sum requested (SCPA 2307). The record reflects that the causes of action were settled before trial for $600,000.00. The settlement was approved by a Compromise Order of the Supreme Court, New York County, dated September 20, 2018, which approved the legal fees and disbursements of Bamundo, Zwal & Schermerhorn, LLP, petitioner’s counsel, the payment of $155,000.00 to the New York City Human Resources  Administration, Department of Social Services, in satisfaction of its lien and directed that the net balance be held in an interest-bearing escrow account, pending further Decree of this court. The proposed allocation of 100 percent of the net proceeds to the cause of action for decedent’s conscious pain and suffering is granted. The net balance shall be distributed as set forth in the Decree. Decree settling Administrator’s account signed. Dated: March 19, 2020
