ESTATE OF YUK MUI NG, Deceased, (08-4560/A/B/C) — The proposed compromise of the causes of action for decedent’s conscious pain and suffering and wrongful death is approved. The Administrator is authorized to collect the settlement proceeds and execute any necessary receipt and releases. Petitioner’s request that the proceeds be allocated entirely to the cause of action for decedent’s wrongful death is granted. The Medicaid claim against decedent’s estate from New York City Department of Social Services/HRA related to medical services rendered to decedent in connection with her injuries are allowed (EPTL 5-4.4[b]). Reimbursement for decedent’s funeral expenses and statutory commissions (SPCA 2307) have been waived. Counsel’s legal fees are fixed and disbursements allowed. The balance of the settlement proceeds shall be paid as set forth in the Decree. Decree settling Administrator’s account is signed. Dated: July 23, 2020
