Surrogate Mella ESTATE OF HERMAN J. HELLMAN, Deceased (15-1194/F) — At the call of the September 16, 2020 calendar, the court granted the motion of Dentons US LLP to withdraw as counsel for Henrik Thomassian, co-petitioner in the proceeding to settle the intermediate account of Mr. Thomassian, now former co-executor, and Scott S. Rosenblum, sole remaining executor, of the will of Herman J. Hellman (see CPLR 321 [b] [2]). The motion was unopposed; Mr. Thomassian defaulted. Dentons US LLP had represented both petitioners until Mr. Rosenblum retained new counsel on July 8, 2020. Shortly thereafter, Mr. Rosenblum petitioned successfully for the revocation of Mr. Thomassian’s letters testamentary and for a decree directing Mr. Thomassian to turn over millions of dollars to the estate. In view of the materially adverse interests of movant’s former and current clients regarding the administration of decedent’s estate, movant’s withdrawal from the representation of Mr. Thomassian in the executors’ accounting is appropriate (see Rules of Professional Conduct [22 NYCRR 1200.0] rule 1.9). The accounting is stayed for 30 days from the date on which movant serves a copy of this order — in effect, a notice to appoint another attorney — upon Mr. Thomassian by e-mail, at: [email protected] (see CPLR 321 [c]). This decision, together with a transcript of the September 16, 2020 proceedings, constitutes the order of the court. Clerk to notify. Dated: September 18, 2020
