ESTATE OF THELMA NOVICK, Deceased (14-3738) — In an SCPA Article Ten proceeding in the estate of Thelma Novick, this court issued letters of administration to Lynn Wasserman on July 1, 2015, as amended on November 4, 2016, which restricted petitioner from distributing assets of the estate pending a determination of kinship. Based upon the proof submitted at a kinship hearing before a court attorney-referee, and the report of the New York County Public Administrator, appearing on behalf of unknown distributees pursuant to SCPA 1123(2)(i)(2), the court finds that the decedent was survived by one paternal cousin, Florence Kamen, and eight maternal cousins: Tobias Cohen, Sylvia Chortek, Saul Scherr, Melvin Kalechstein, Martin Leslie Cohen, Donald Edwin Cohen, Joseph Edward Josephson, and Lynn Wasserman.1 The court is satisfied that diligent efforts have been made from all available sources to determine the existence of other distributees, and, therefore, holds that no other distributees exist, except those whose status is established in this record (SCPA 2225). Upon the consent of all necessary parties, the restrictions on the letters of administration previously issued are removed and letters of administration without restrictions are granted to Lynn Wasserman, to serve without bond, upon her duly qualifying according to law. This decision constitutes the order of the court. Settle decree allowing for compensation to counsel for the Public Administrator. Dated: November 20, 2020
