ESTATE OF AGNES EGAN, Deceased (19-720/B) — The administrator, the decedent’s daughter and sole distributee, seeks to compromise causes of action arising from the decedent’s death and to judicially account for the settlement proceeds, a no-fault death benefit and additional estate assets. The decedent died intestate on February 14, 2019 as a result of injuries she sustained when she was struck by a school bus while a pedestrian. Under the circumstances presented, including the consent of the New York State Department of Taxation and Finance, and the lack of any unpaid debts or claims presented herein, the court grants the request to allocate the net distributable proceeds to the wrongful death cause of action. Disbursements and counsel fees are allowed in the amounts requested. The net distributable settlement proceeds, no-fault death benefit and the additional estate assets are to be paid to the daughter (see EPTL 4-1.1 [3]; EPTL 5-4.4). Decree signed October 27, 2020
