Surrogate Mella ESTATE OF R.H., a Ward (13-2623/C) — The court grants as follows this unopposed petition under SCPA 2110 by counsel to Maria de Fatima Silva Sanches, as both the property guardian of R.H., a ward pursuant to Article 17-A of the SCPA, and as the trustee of a supplemental needs trust that benefits R.H. The request by her counsel for fees in the sum of $27,954.50 — for 79.10 hours of work covering the period of August 5, 2015 to January 2, 2019 — are allowed under the factors for analyzing fee requests provided in the Potts and Freeman cases (see Matter of Potts, 123 Misc 346 [Sur Ct, Columbia County 1924], aff’d 213 App Div 59 [4th Dept 1925], aff’d 241 NY 593 [1925]; Matter of Freeman, 34 NY2d 1 [1974]). However, regarding disbursements, petitioning counsel has failed to substantiate $1,000 of the $1,488.02 claimed, in that the $1,000 disbursement for an unidentified New Jersey attorney is not sufficiently supported. Consequently, disbursements are allowed in the reduced amount of $488.02, without prejudice to a later application seeking to recoup this $1,000 disbursement upon a proper showing. Accordingly, the petition is granted only the extent set forth herein. Decree signed. Dated: December 28, 2020
