Surrogate Mella ESTATE OF CHEUK-SHEUNG LEE, Deceased (17-4400/A/B/C) — The court grants this unopposed petition by Fung Yen Lee, as administrator of the Estate of Cheuk-Sheung Lee, to account for a $622,285.75 award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts" ]). Decedent, who was in the “exposure zone” as defined by the 9/11 Acts, died on March 30, 2012, from lung cancer which he contracted through his exposure during and in the aftermath of the terrorist attacks on September 11, 2001. Decedent is survived by a wife and two adult sons. The record further reflects that decedent was 64 years old and retired at the time of his death. The VCF award is based entirely on non-economic losses. Petitioner’s request to allocate the proceeds 100 percent to the cause of action for conscious pain and suffering, is approved. The restrictions contained on the Letters of Administration issued to petitioner are modified to allow this compromise, and petitioner is authorized to collect the award and execute any receipts and releases that may be required. Attorneys fees are fixed at a rate of 10 percent of the award inclusive of disbursements, as provided by the 9/11 Acts. Statutory commissions are waived (SCPA 2307). The net award shall be distributed as set forth in the decree. Decree settling Administrator’s account signed. Dated: May 5, 2021
