DECISION ORDER ON MOTION Upon the foregoing documents, the motion is granted. Plaintiff Maria Sicola brings this action against her former employer, defendant Cushman & Wakefield, Inc. (defendant or C&W), for age and gender discrimination, retaliation and failure to prevent harassment, discrimination and retaliation in violation of California’s Fair Employment and Housing Act (FEHA) (see Cal Govt Code §§12900, et seq.), unfair competition in violation of California’s Business And Professions Code (see Cal Bus & Professions Code §§17200, et seq.), and wrongful termination under California public policy. Defendant moves, pursuant to CPLR 3212, for summary judgment dismissing the complaint. FACTUAL BACKGROUND Plaintiff, a California resident, is a woman over the age of 40 (NY St Cts Elec Filing [NYSCEF] Doc No. 86, Blythe E. Lovinger [Lovinger] affirmation, exhibit 1, 4). Defendant is an international commercial real estate firm with headquarters in New York (NYSCEF Doc No. 87, Lovinger affirmation, exhibit 2, 20). In 1981, defendant hired plaintiff as a Research Manager in its New York City office (NYSCEF Doc No. 84, defendant’s Statement of Undisputed Material Facts, 1). Since then, she has held the positions of Director, Senior Managing Director of U.S. Research Services, Executive Managing Director of U.S. Research Services, and Executive Managing Director, Head of Americas Research, all within the Research Department (id., 2; NYSCEF Doc No. 96, Lovinger affirmation, exhibit 11 at 2). Plaintiff moved to defendant’s San Francisco office in 2006 (NYSCEF Doc No. 86, 18). The Research Department is primarily considered a “service line.” It supports defendant’s revenue-generating lines by tracking and reporting on historical and current real estate trends and forecasting market behavior (NYSCEF Doc No. 84,
16-17 and 19). The department partners with regional presidents and market leaders to meet their needs in their respective geographic regions, and the regional presidents help oversee the service lines operating in their areas (id., 20). In 2014, the regional presidents were Joseph Cook (Cook); Shawn Mobley (Mobley); Ron Lo Russo (Lo Russo); and Bill Magner (Magner) (id., 18).
