ESTATE OF CANDELARIA RIVERA, Deceased (16-773/A/B/C) — The petition of Julia Quintana, as Administrator of the estate of her mother, Candelaria Rivera, deceased, for leave to compromise causes of action for decedent’s conscious pain and suffering and wrongful death, is granted. The Administrator is authorized to collect the compromise proceeds and to execute such receipts and releases as may be required. The proceeds of the settlement are allocated entirely to the cause of action for conscious pain and suffering. The attorneys fees requested have been approved and disbursements allowed in a reduced amount in accordance with Matter of Herlinger (NYLJ, Apr. 28, 1994, at 28, col 6 [Sur Ct, New York County]). Petitioner is authorized to pay the New York City Department of Social Services (Medicaid) in the amount of $62,975.15, and ArchCare Advantage (Medicare) in the amount of $14,450.56, in full satisfaction of their respective liens. Petitioner is permitted to pay herself $1,442.00 as reimbursement for the payment of decedent’s funeral expenses, and petitioner is further permitted to pay herself $11,000 as statutory commissions pursuant to SCPA 2307. The balance of the settlement proceeds shall be distributed as follows: one-third to petitioner, one-third to Maria Quintana, one-sixth to Juan Gabriel Quintana and one-sixth to Brenda Liz Quintana as decedent’s distributees pursuant to EPTL 4-1.1(a)(3).
