ESTATE OF CARLA K. ROSADO, also known as CARLA DOUGAL ROSADO, Deceased (19-1114/A) — The administrator, the decedent’s spouse, seeks to lift the restrictions contained in his limited letters of administration so that he may receive and judicially account for the settlement proceeds of a personal injury cause of action. The decedent sustained injuries due to alleged negligence on January 16, 2017 and later died intestate on August 12, 2018 of unrelated causes. Her sole distributee is the petitioner, who assigned one-half of his interest in the proceeds to the decedent’s mother, who consents to the application. Jurisdiction was obtained over all necessary parties and creditors, including the New York State Department of Taxation, and there were no appearances on the Court’s virtual platform at the return date of the citation which was held remotely nor have they indicated opposition to the court to date. Disbursements and counsel fees are allowed in the sums requested. The following claims are to be paid from the net distributable proceeds as follows: $10,000.00 to New York Spine Institute; $2,975.88 to the New York City Department of Social Services/HRA (“HRA”); $900.00 to NS Radiology, PLLC; $2,300.00 to Stand-Up MRI of the Bronx PC; $5,000.00 to Interventional Physical Medicine and Rehabilitation, PC; $6,000.00 to RobinsPsych; $650.00 to Hostin Orthopedics and Sports Medicine, PC; $599.26 to Peter C. Kwan M.D. PC; and $85,000.00 to Case Cash GP LLC. The net distributable proceeds are to be paid in the manner requested. As requested, the sum of $10,614.00 is to be paid to HRA by deduction from the petitioner’s amended distributive share in satisfaction of its public assistance claim asserted against him individually.
