ESTATE OF FRANCES HINES, also known as FRANCES E. HINES, Deceased (20-88) — In this application by an alleged creditor for the issuance of limited letters of administration to an eligible distributee of the decedent or the Public Administrator, consents were filed for two sons, the decedent’s only distributees, and the Public Administrator appeared and filed a written consent to the issuance of full letters of administration. Accordingly, the application is granted and letters of administration shall issue to the Public Administrator as consented to. Settle decree. January 18, 2022

ESTATE OF JOSE JAVIER, Deceased (08-2526/A) — The decedent’s spouse, who received ancillary letters of administration, seeks to lift the restrictions on her limited letters so that she may collect and judicially account for the remaining proceeds of a personal injury cause of action settled in the Supreme Court, Bronx County (Tuitt, J.) being held in her attorneys’ escrow account. The supreme court order, inter alia, directed the payment of attorneys’ fees and disbursements. The decedent sustained injuries allegedly as a result of an automobile accident on November 22, 2006 and died intestate on November 29, 2007 of unrelated causes. Citation issued to the decedent’s three children, one of whom is under a disability, and has since post-deceased; two children appeared, including the Article 81 guardian of the son under a disability, and the last distributee failed to appear on the court’s virtual platform and no objections by her have been received to date. The guardian ad litem (“GAL”) appointed to represent the son under a disability and the New York State Department of Taxation and Finance consent to the application. Counsel’s request for $240 is allowed in reimbursement of disbursements in the instant proceeding. As agreed by the parties, the GAL’s fee shall be paid from the net distributable proceeds and the remaining proceeds shall be paid to the fiduciary upon her posting a bond in the penal sum of $259,000. Settle decree. January 19, 2022
