ESTATE OF JEAN LAMB BENSON, Deceased (05-1880/D) — It having been brought to the court’s attention that a temporary conservator was appointed for the Executor, after a court of competent jurisdiction found, from medical and other evidence presented, that the Executor “is incapable of managing his affairs and caring for himself,” the Executor’s letters testamentary are hereby revoked sua sponte (SCPA §§711, 719[6] [10]) . The court appoints petitioner, Pamela Kancler, as successor executor upon her duly qualifying according to law. Regarding the request to compel an account, the court will schedule a conference with the parties to resolve that aspect of the petition. The Clerk of the Court is directed to mail a copy of this decision to the temporary conservator of the Executor. This decision constitutes the order of the court.
