ESTATE OF EMMANUEL MENSAH, Deceased (18-2750/A) — The administrator, the decedent’s father and sole distributee, seeks to lift the restrictions contained in his limited letters of administration so that he may distribute the remaining proceeds of causes of action settled in the Supreme Court, Bronx County (Torres, J.) which are being held in his attorneys’ escrow account. The supreme court order, inter alia, directed the payment of counsel fees. The decedent sustained injuries in an apartment fire and died on December 28, 2017. Under the circumstances presented, including the consent of the New York State Department of Taxation and Finance and the lack of any unpaid debts or claims presented herein, the request to allocate the net distributable proceeds equally to the causes of action for personal injury and wrongful death is granted. Trial counsel recently waived disbursements. The remaining proceeds for both causes of action are to be paid to the father. The restrictions imposed upon the administrator and his counsel shall remain in full force and effect with regard to any remaining defendants and causes of action. Decree signed. March 24, 2022
