ESTATE OF ADELAIDA MARCANO, also known as ADELAIDA LEE MARCANO, Deceased (19-2500/A) — In this SCPA 2103 proceeding, the administrator, a daughter of the decedent, petitions by order to show cause for an order ejecting the respondent, the decedent’s companion, from the decedent’s two-family home and turnover of certain personal property belonging to the decedent. On the first return date of process, on or about September 29, 2020, the respondent appeared remotely by counsel on the court’s virtual platform and the matter was marked “supplemental process” to allow petitioner to obtain jurisdiction over additional individuals believed to reside in the decedent’s home, for whom the petitioner would be seeking the same relief. On the return date of the supplemental citation, jurisdiction was complete upon all parties, and the respondent appeared remotely by counsel. Thereafter, an off calendar conference was held with a member of the court’s Law Department at which respondent’s counsel indicated that although there objections may not be meritorious, the respondent needed additional time to vacate the premises. Although the petitioner offered an additional 90 days, the parties were unable to agree upon a vacate date. ESTATE OF ALINE COLTER, Deceased (21-1956) — In this application by one of the decedent’s daughters seeking the issuance of letters of administration, consents were filed for five other children. Jurisdiction was obtained over another daughter, and there was no appearance in opposition on the virtual hearing date nor was any opposition to the application received by the court to date. Accordingly, in the absence of any opposition, the application is granted, and letters of administration shall issue to the petitioner subject to the provisions of SCPA 805 (3) with regard to the disposition of any real property.
