Surrogate Malave-Gonzalez ESTATE OF ALPHONSO McGRUDER, Deceased (18-2023/A) — In this proceeding, the administrator, a desginee of the distributees, seeks to compromise causes of action arising from the decedent’s death and judicially account for the settlement proceeds. The decedent died on November 28, 2017, allegedly as the result of medical malpractice. The decedent’s distributees, three adult children, consent to the application. Under the circumstances presented, including the consents of the distributees and the New York City Department of Taxation and Finance, the lack of any unpaid debts or claims presented herein, and the fact that the decedent never regained consciousness, the court grants the request to allocate the net distributable proceeds entirely to the wrongful death cause of action. Disbursements and counsel fees, which are pursuant to Judiciary Law §474-a, are allowed in the sums requested. The sum of $4,300.75 and $1,480 are to be paid to the petitioner and Orlando McGruder, respectively, in reimbursement of the decedent’s funeral expenses. The net distributable proceeds are to be paid to the children in equal shares [EPTL 4-1.1 (a) (3)]. Submit decree. June 22, 2022
ESTATE OF CARMEN ROQUE FIGUEROA, Deceased (16-2900/A) — In this estate, the decedent’s grandson moved by order to show cause seeking to, inter alia, revoke the letters of administration that issued to decedent’s spouse and to be appointed administrator d.b.n. The spouse appeared by counsel and put in opposition to the application. The decedent’s only other distributees, two grandchildren, filed consents to the application. After several conferences the parties have entered into a stipulation which provides, inter alia, that the spouse’s letters shall be revoked and the spouse consents to the appointment of the grandson as fiduciary of this estate. Accordingly, this decision constitutes the order of the court revoking the letters of administration issued to the spouse and the petitioning grandson herein may be appointed administrator d.b.n. upon his filing the appropriate application and duly qualifying. Settle decree. June 22, 2022
