ESTATE OF ANNAMMA DANIEL, Deceased (19-2667/A) — In this estate, a son of the decedent petitioned pro se for letters of administration. The whereabouts of the decedent’s other distributee, another son, are unknown. On January 11, 2021, the petitioner was awarded temporary letters of administration containing restrictions pursuant to SCPA 702 (1) with regard to a possible cause of action and SCPA 805 (3) with regard to a condominium apartment located in the Bronx. The temporary letters have long expired. The son subsequently retained an attorney who filed a petition seeking to lift the SCPA 805 (3) restrictions and annexed a contract of sale for the condominium to a third party. Counsel advised the court that the condominium board of managers has commenced a foreclosure action for outstanding common charges. Although the realty should be expeditiously sold, the petitioner is unable to obtain a bond and cannot qualify as a fiduciary. Accordingly, the petitioner amended the petition to seek the issuance of letters of administration the Public Administrator. On the return date of citation in the amended application, counsel for the Public Administrator appeared and subsequently filed a written consent to the issuance of letters. Accordingly, in order to preserve the estate assets and expedite the administration of this estate, this decision constitutes the order of the court granting the son’s amended petition (File No. 2019-2667) and dismissing the petition seeking to lift the SCPA 805 (3) restrictions (File No. 2019-2667/A). Letters of administration shall issue to the Public Administrator upon duly qualifying therefor. The court dispenses with jurisdiction over the George Daniel, whose whereabouts are unknown, in this proceeding; however, jurisdiction is to be obtained over him in any accounting or other appropriate proceeding. The temporary letters of administration issued to the petitioner are to be revoked in the decree to be entered hereon. Settle decree consistent with this decision and order. September 7, 2022
ESTATE OF BUENAVENTURA MANZUETA, Deceased (22-497) — In this application for limited letters of administration by one of the decedent’s sons, citation issued to four other children, decedent’s only other distributees, and there was no appearance in opposition on the virtual hearing date nor has any opposition to the application been received by the court to date. Accordingly, the application is granted and letters of administration may issue to the petitioner, limited pursuant to SCPA 702 (1). Submit decree. September 2, 2022
