ESTATE OF LUISA ROSARIO, Deceased (16-1974/A/B/C) — The proposed compromise and settlement of the causes of action for decedent’s wrongful death and conscious pain and suffering against the settling defendants for the sum of $100,000.00 is approved. The restrictions contained in the Letters of Administration issued to the Administrator are modified to allow this compromise and Petitioner is authorized to compromise the causes of action, execute any necessary receipt and releases and collect the net settlement proceeds. Petitioner’s request to allocate 100 percent of the settlement proceeds to the cause of action for wrongful death is granted. The Medicare claim asserted by the Centers for Medicare and Medicaid Services is allowed and may be paid as requested (see EPTL 5-4.4[b]). Attorneys fees and disbursements are approved in the amounts requested. Payment of statutory commissions (SCPA 2307) and reimbursement of funeral expenses have been waived. The balance of the net settlement proceeds shall be paid as set forth in the Decree. Decree settling the Administrator’s account is signed. Dated: September 15, 2022
