ESTATE OF ANDREA M. BUSH, Deceased (22-812) — In this uncontested proceeding, an aunt of the decedent petitions for letters of administration. In addition to the petitioner, the distributees who are eligible to serve as the estate’s fiduciary are an uncle and four other aunts. One of those aunts is under an alleged disability. Jurisdiction was obtained over all necessary parties. On the citation’s return date no one appeared on the court’s virtual platform in opposition to the application. To date, no one has objected to the relief sought in the petition. The aunt who is alleged to be under a disability was cited and did not appear on the court’s virtual platform on the return date. If her alleged disability prevented her from appearing, then it seems that she would be ineligible to serve as a fiduciary of this estate. On this state of the record, a guardian ad litem is not needed here to represent the aunt under an alleged disability. ESTATE OF EUGENE MURPHY, Deceased (22-427) — In this application by a daughter of the decedent for the issuance of letters of administration, jurisdiction was obtained over two other daughters of the decedent, without any appearance on the court’s virtual platform nor has any opposition been received to date. The petition indicates that decedent’s spouse post-deceased him, her distributees are the same as the decedents and no administrator has been appointed for her estate. The petition indicates that although the decedent lived in Ireland, the only asset of the estate is $60,000 in personal property located in Bronx County, New York and there will not be a probate proceeding commenced in Ireland. Under these circumstances, including the consents of the other distributees and the fact that the only property of the estate is situated in Bronx County, this court may exercise jurisdiction over this proceeding (see SCPA 206). Accordingly, in the absence of any opposition, the application is granted and letters of administration shall issue to the daughter upon her filing a bond in the penal sum of $60,000.00.
